Notsu OÜ, a private limited company registered in Estonia under registry code 16305121, VAT number EE102489600, registered address Soo tn 2, 10414 Tallinn, Estonia ("Notsu", "we", "us"), operates the FishSmash service. These Terms form a binding agreement between you and Notsu OÜ for your use of the FishSmash website and application. Please read them together with our Privacy Notice, Cookie Notice, Community Rules, Rewards Rules, AI Transparency Notice, Agency Mandate Disclosure and Affiliate Disclosures, all of which are part of this agreement.

1. What FishSmash is

FishSmash is a fishing gear discovery, compatibility, price-check, catch diary, community and rewards service. You can paste a retailer product link or search by product name or photo, and we read the retailer's own published product data to show you price, availability and specification information with the time of the check.

FishSmash also includes a deterministic gear compatibility engine (rod, reel, line, lure and species/method matching), a personal gear inventory, a private-by-default catch diary, an opt-in community feed, an activity-based rewards programme and optional AI assistants.

FishSmash is an information and assistance service. It is not a shop. We do not hold stock, we do not set retailer prices and we are not the seller of any fishing gear you buy.

2. Our role: disclosed customer-side purchasing agent

Where you choose to buy gear after using FishSmash, the retailer you select is the seller, the merchant of record and the recipient of your payment. You pay the retailer directly on the retailer's own checkout. Notsu OÜ never becomes the seller of the goods and never stores your card data.

Notsu OÜ acts only as your disclosed customer-side purchasing agent: we help you find, compare and verify offers and, where you explicitly instruct us, we pass your purchase intent to the retailer. The contract of sale for the goods is concluded between you and the retailer.

This means the retailer is responsible for the product contract, payment processing, delivery and fulfilment, statutory conformity (legal guarantee), withdrawal/returns handling, warranty and after-sales service. Our Agency Mandate Disclosure explains the mandate in detail.

Nothing in these Terms removes or limits your mandatory rights as a consumer against the retailer, or against us for the service we ourselves provide.

3. Live checks, demo catalogue and accuracy

There are two kinds of product data in FishSmash, and we label them everywhere they appear.

  • Live page checks: when you paste a public product URL, our server fetches that page once, through public-host, redirect, size and timeout guards, and reads only the shop's own structured data (JSON-LD, microdata, OpenGraph or a public Shopify product endpoint). The result is timestamped. We never estimate a missing field.
  • Demo catalogue: seeded example products, recommendation offers and challenge previews used to demonstrate the interface. These are labelled "Demo catalog — not live" and their prices, stock and delivery figures are illustrative only.
  • Merchant feeds: approved merchant sources ingest offers with provenance. Their live/off state is published on the Live coverage page.

4. Price and availability disclaimer

A live check is a snapshot of one moment. Prices, stock, shipping costs and delivery times change without notice, and shops sometimes publish stale structured data. Always re-run a check immediately before buying, and confirm the final amount, delivery cost and availability on the retailer's own checkout page.

We do not guarantee that any offer shown is still available, correctly priced or lawful to ship to your address.

5. Affiliate compensation

Some retailer links may carry an affiliate or referral parameter, and we may receive a commission if you buy. This never changes the price you pay and never changes ranking. Ordering is derived only from verified all-in price, freshness, stock and deterministic retailer evidence. Full detail is in our Affiliate Disclosures.

6. Accounts and eligibility

You must be at least 16 years old to create a FishSmash account. You are responsible for the accuracy of your account details and for keeping your credentials confidential. One person, one account.

When you create an account you must actively accept these Terms and acknowledge the Privacy Notice. We do not use pre-ticked boxes. When we publish a new version of either document, you must accept the current version before you can upload a catch, redeem a reward or approve a purchase intent. We record which version you accepted and when.

7. Acceptable use

You agree not to misuse the service. In particular you must not:

  • submit false, exaggerated or fabricated catch data, or attempt to farm points or prizes;
  • upload content you do not own or have the right to publish;
  • publish exact locations of other people's fishing spots, or content that reveals another person's whereabouts;
  • use FishSmash to plan, promote or record illegal fishing, wildlife harm or protected-species catches;
  • scrape, resell or systematically extract FishSmash content, or use automated agents against the service;
  • attempt to bypass authentication, rate limits, moderation or role checks;
  • upload malware or content that harasses, defames or endangers anyone.

8. Your content and the licence you grant

You keep all rights in the photos, catch records and text you upload. You grant Notsu OÜ a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt technically (for example resizing and re-encoding) and display your content strictly for the purpose of operating, securing, moderating and displaying the FishSmash service to you and, where you have opted in, to other users.

This licence is limited to operating the service. It does not allow us to sell your photos, licence them to third parties for advertising, or use them outside FishSmash without asking you separately. The licence ends when you delete the content, except for copies we must keep for a limited period for legal, security or dispute reasons, and for content already shared onward by other users where deletion is technically impossible.

You confirm that you have the right to upload each photo, that any identifiable person in it has agreed, and that the catch shown was lawful where and when it was made.

9. Reports, moderation and takedowns

Every shared catch card carries a report control. Reports go to our operators, who review them and may hide, reject or remove content, and may suspend or terminate accounts for serious or repeated breaches. We aim to act on reports of illegal content without undue delay.

If your content is removed you may contest the decision through the contact form, selecting the "Content report" category and quoting the reference number.

10. Rewards

The rewards programme is described in the Rewards, Challenges and Prize Rules, which form part of these Terms. Points have no cash value, are non-transferable and can be adjusted or cancelled where abuse or a technical error occurred.

11. Service availability and changes

FishSmash is provided on an ongoing but not uninterrupted basis. We may change, suspend or discontinue features, and we may perform maintenance. Some capabilities depend on external providers (retailer pages, merchant feeds, discovery connectors, AI providers). Where a provider is not configured or is unavailable, the interface says so honestly rather than showing invented data.

We will give reasonable notice of material adverse changes to these Terms or to paid or reward-bearing features where the law requires it.

12. Intellectual property

The FishSmash name, logo, interface, illustrations, compatibility rules, code and documentation are owned by Notsu OÜ or its licensors. Retailer names, brands and product images belong to their respective owners and are shown for identification and comparison only.

You receive a personal, revocable, non-transferable right to use the service for your own non-commercial fishing purposes.

13. Warranties and liability

We provide the FishSmash service with reasonable skill and care. To the extent permitted by law, and without limiting your mandatory statutory rights, we do not warrant that product data is complete, current or error-free, that a compatibility result guarantees safety or performance, or that any AI output is accurate.

We are liable for damage caused intentionally or by gross negligence, for death or personal injury, and for any other liability that cannot be excluded under mandatory law. Otherwise our liability for the service is limited to foreseeable damage typical for this kind of free service.

We are not liable for the goods themselves, for retailer delivery, for retailer payment processing, or for a retailer's failure to perform. Those claims lie against the retailer as seller.

Fishing carries physical risk. You are responsible for your own safety, for holding any required fishing licence or permit, and for complying with local fishing regulations, closed seasons, minimum sizes and protected species rules.

14. Suspension and termination

You may stop using FishSmash and delete your account at any time through the Privacy Centre. We may suspend or terminate access where you materially breach these Terms, where required by law, or where continued access would create a security or safety risk. Where proportionate we will warn you first and explain the reason.

15. Governing law and consumer protection

These Terms are governed by Estonian law. If you are a consumer resident in the European Union, this choice of law does not deprive you of the protection of the mandatory consumer rules of your country of habitual residence, and you may bring proceedings in the courts of that country.

16. Complaints and dispute resolution

Complain first to the right party. For anything about the goods — price charged, payment, delivery, damaged item, returns, warranty — complain to the retailer who sold you the item, because the retailer is the seller and merchant of record. For anything about the FishSmash service itself — the app, an incorrect comparison, your account, rewards, moderation, privacy — complain to Notsu OÜ through the contact form.

We aim to acknowledge complaints within 5 working days and to respond substantively within 15 working days.

If we cannot resolve your complaint, a consumer resident in Estonia (or buying from an Estonian trader) may refer the dispute free of charge to the Consumer Disputes Committee at the Estonian Consumer Protection and Technical Regulatory Authority (Tarbijakaitse ja Tehnilise Järelevalve Amet, TTJA), Endla 10a, 10122 Tallinn. You may also always go to court. Nothing here limits that right.

We have not yet published a public support email address. Until we do, the fastest and only guaranteed route to us is the in-app contact form at /contact, which creates a tracked request with a reference number that our operators work through. Do not rely on any email address for FishSmash that you did not receive from us directly.
